Terms and Conditions

Context
Within the framework of the Independence Bicentennial of Costa Rica, the Vice Presidency of the Republic, the Ministry of Environment and Energy (MINAE), the Environmental Bank Foundation (FUNBAM), the National Forest Financing Fund (FONAFIFO), and the United Nations Development Program (UNDP) wish to celebrate and contribute to the process of decarbonization and biodiversity, through a large-scale tree planting campaign. Greening both the northern region of Costa Rica and the economy, for the enjoyment of all people and the planet.
Unlike other worldwide tree planting initiatives, this project seeks to guarantee survival success by generating jobs for ongoing tree maintenance and stewardship, for a period of five (5) years. In addition, the program uses an interactive map that allows users to view where each tree has been planted, as well as other detailed information about each planted species.
According to statistical employment data in Costa Rica, for the second quarter of 2020, the unemployment rate reached 24%. When separating the data by sex, unemployment in the male population was estimated at 20%, while the female unemployment rate is 30.4% (INEC, 2020).
For this reason, the primary purpose of this initiative is to generate green jobs, which ensure equitable access for women and thereby guarantee their empowerment, financial autonomy and, in turn, ensure a better tomorrow for future generations.
In the midst of the current economic crisis – a product of the COVID-19 pandemic – we are looking for a way to rebuild our future and work hand in hand with nature to shape a greener, more supportive, more inclusive and more sustainable future.
For this reason, Huella del Futuro #Footprint4ourFuture was created: Born as a collective financing initiative via a donation platform, in which all sectors can participate – from individuals to large companies. Our goal is to raise the funds necessary to plant and maintain, for a 5-year period, trees that will allow for the reforestation of 400,000 hectares (988,500 acres) in the Northern Zone of Costa Rica.
This initiative has set a goal to plant native and timber trees that can survive changes to our climate, as a means of facing the threat of biodiversity loss while contributing to a new generation of green jobs, by promoting income sources for unemployed individuals or those who have suffered a significant reduction in income, paying special attention to women in these conditions.
Huella del Futuro #Footprint4ourFuture will support planting projects in areas of water importance; biological corridors, both natural and interurban; protection areas; Protected Wildlife Areas under various management categories; National Natural Heritage sites; agroforestry and silvopastoral systems; and forest plantations, as well the work of the crews tasked with planting, monitoring and maintenance, and the brigades that fight forest fires.
Funds generated by the Huella del Futuro program may not be used to finance repairs to environmental damage, which must be assumed by the natural or legal person responsible for the damage, when this is so established by the competent authorities, through a court ruling or administrative resolution.
General Terms of Use and Conditions
The Huella del Futuro program operates a secure computer platform (hereinafter called the “Website”) to facilitate monetary donations to support tree planting on 400,000 hectares (988,500 acres) in the Northern Zone of Costa Rica.
This Website is the property of the Environmental Bank Foundation (hereinafter called “FUNBAM”), which directly manages the resources raised by the Huella del Futuro. FUNBAM is a foundation created under Law 8640 and whose Board of Directors is comprised of the highest authorities from MINAE, MAG, SINAC, and FONAFIFO, as well as a representative from the National Bank, being an organization legally constituted under the laws of the Republic of Costa Rica.
The use of this Huella del Futuro Website and its content are governed by the Terms and Conditions of Use (hereinafter "Conditions"), indicated below. Users acknowledge having read, understood, and accepted all applicable Conditions, when entering and / or using the information and donation services on the Website.
To make donations through the Website, users are required to accept these Conditions, comply with online donation registration, and must have their own credit or debit card, from any bank or similar issuer.
By accepting these Conditions, Website users declare that they understand that these are binding and are subject to a process of continuous improvement, for which they can be reviewed and modified at any time by FUNBAM. The communication of any change to the Conditions will be conducted through publishing an updated version on the Website; there will be no obligation to individually notify users of any modifications made. Therefore, users accept that it will be their sole responsibility to periodically review the Website, in order to verify any changes to these Conditions. The continued use of this site, after modifications, represents the user's acceptance of these modified terms.
At the time of donation registration, the user in charge of the transaction must obligatorily declare acceptance of these Conditions. Therefore, if there are any doubts regarding scope or the Huella del Futuro program, it will be considered the users’ responsibility to contact FUNBAM by email: info@huelladelfuturo.org
By accepting these Conditions, the user declares and states, under oath, that the funds used for this donation come from legal activities compatible with the institutional values of FUNBAM and the strategic partners that support the Huella del Futuro program. FUNBAM may, among other measures, block donations from users linked to or suspected of being linked to money laundering activities, terrorist financing, human trafficking or any other activity, legal or illegal, that may represent a reputational risk; this will not represent any responsibility for FUNBAM.
Likewise, FUNBAM reserves the right to refuse, deny or interrupt access to the Website for any user who, in its opinion, has breached these Conditions, or who may represent a security or reputational risk for FUNBAM.
Possible transactions on the Huella del Futuro Website correspond to direct donations only. The Website will not assess a charge for affiliation or membership. Likewise, there will be no commercial, contractual, or professional relationship between Website users and FUNBAM.
If any of the Conditions or Policies of this Website is considered null or invalid, either in whole or in part, this will not affect the validity of the others.
Restrictions on Obligations
In accordance with the Huella del Futuro Privacy Policy, FUNBAM will take commercially reasonable security measures to ensure the integrity of this Website. However, FUNBAM will not be responsible for economic losses, damages, or harm caused by viruses to the computers or mobile devices of users who access the Website to view, copy, or download content.
In no case will FUNBAM be liable to Website users or visitors, or to third parties, for direct, indirect, punitive, contingent damages, special incidents, or critical damages (including loss of data, income, profits, or other economic advantages). Additionally, the user acknowledges and accepts that the proper handling and custody of passwords, keys, pins, and any other sensitive information that is necessary to enter the Website, will be their sole and exclusive responsibility and that, therefore, the user will be responsible for all activity that occurs through the use of its Record.
Any false or inaccurate information that a user enters on this Website will be the sole responsibility of that user, who, without prejudice to any possible legal responsibilities that may correspond, must hold FUNBAM totally harmless.
Information Security
Once the payment section has been identified and filled in, any data sent by the user at the time of transaction, is transmitted through a secure and encrypted connection, using the Secure Socket Layers (SSL) protocol.
FUNBAM will carry out all transactions through the National Bank of Costa Rica payment platform, which has been certified and is regulated by the General Superintendency of Financial Entities (SUGEF).
Accountability on the Use of Funds
For the purposes of the Huella del Futuro program, FUNBAM will publish and update an interactive map on the Website, with details on the location of the trees whose planting are financed through donations. Neither FUNBAM nor their partners in execution can guarantee the survival of 100% of the trees that are planted; however, investing in ongoing maintenance, stewardship, and firefighting brigades will allow for high tree survival rates, over a period of 5 years.
Refund Requests
Donations made to the Huella del Futuro program may be refunded, in the event that the person who owns the payment card states that they have made a mistake when selecting the Quantity or type of package they wish to support. To request reimbursement of a recent donation, please contact info@huelladelfuturo.org within a period of no more than two (2) business days after the transaction is made. Reimbursement requests must be made only for the card used to complete the donation, following the required guidelines from the issuing entity.
Refund requests for transactions made via electronic transfer or mobile SINPE may be processed with a maximum period of 30 days. For any refund request, it will be necessary to report the request via email: info@huelladelfuturo.org
Logo Use
The logos and graphics for Huella del Futuro and hashtag #Footprint4ourFutur belong to FUNBAM; their use, reproduction, copying, publication, or partial or total redistribution may be carried out only with express prior authorization, processed in writing and in the presence of FUNBAM.
Use of Teaching Materials for Technical Reference
The Website includes a resource section that raises awareness on this and other initiatives in the field of reforestation. Website users may utilize the didactic materials, technical documents, videos, infographics, and links published on the Website, as long as they reference the original authorship.
External Websites that Link to the Huella del Futuro Website
The Huella del Futuro Website may appear as a link to other Internet sites, which are not under the control, supervision, or maintenance of FUNBAM. Such links are not endorsed by FUNBAM; therefore, the organization will not be responsible for the content of these sites.
External Internet sites that link to the Huella del Futuro Website may not contain materials that are offensive, unlawful, or immoral. Additionally, external sites must not misrepresent their relationship with Huella del Futuro and may not imply that FUNBAM supports the site or its products and / or services.
